Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the PulseFlow mobile application (the "Service") operated by us.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Medical Disclaimer

PULSEFLOW IS NOT A MEDICAL DEVICE.

The Service, including all data, measurements (such as Heart Rate, HRV, Stress, Energy, CNS Tap Test results), and insights provided, is for informational, fitness, and wellness purposes only. It is not intended to substitute for professional medical advice, diagnosis, or treatment.

• Do not rely on the Service for medical decisions.
• Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
• Never disregard professional medical advice or delay in seeking it because of something you have read on the Service.
• If you think you may have a medical emergency, call your doctor or emergency services immediately.

2. Description of Service

PulseFlow provides tools to estimate heart rate and physiological stress using your device's camera (PPG/rPPG technology) and screen interactions (CNS Tap Test).

• Accuracy: While we strive for accuracy, the measurements may be affected by environmental factors (lighting, movement), device hardware limitations, and physiological variations. We do not guarantee the accuracy, completeness, or reliability of any data.

3. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms.

• You are responsible for maintaining the security of your device where your data is stored locally.
• You agree not to use the Service in any way that could damage, disable, overburden, or impair the Service.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of PulseFlow and its licensors. The Service is protected by copyright, trademark, and other laws.

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Limitation of Liability

In no event shall PulseFlow, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use or alteration of your transmissions or content.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
